Residential landlord-tenant law has been completely overhauled. This inevitably leads to differences of opinion about the meaning of newer laws, including differing legal opinions from the courts.
Landlords and tenants often get different results on the same legal issue from one jurisdiction to another, and from one judge to another. While this is always true to a degree, with the sweeping changes to landlord-tenant law there is far more room for interpretation, making differing rulings far more common.
Also, while there were no-cost attorneys in many major Washington counties in the past, there is now a right to counsel in all eviction cases throughout Washington by state law.
The upshot of all this is that there are far more eviction appeals than ever before in Washington.
