I need to move back into my rental property. Can I break the lease with my tenant?


A landlord cannot break the lease with a tenant to move back in the rental property. The tenant has the right to remain in the rental property until the end of the lease term, so long as the tenant in not in breach of the terms, such as paying rent, etc.

If the tenant is month-to-month the landlord can serve a notice to terminate tenancy a/k/a “20-day” notice. If the tenant does not comply with the notice the landlord must evict the tenant through the normal eviction process.
